Just like the USA, Mexico’s states determine marriage laws, so if you’re looking to get married to a Mexican citizen you might be finding some confusing or conflicting information. Don’t worry! There’s a simple process to follow to ensure that your marriage goes smoothly and is legal in both Mexico and the USA.
Marriage Process
First of all, to ensure that you know all the required documentation and steps to take, contact the Registro Civil in the jurisdiction where you will hold your marriage and ask for information about the marriage requirements between a US citizen and a Mexican.
In general, you will need to fill out an application for marriage, provide your visa or document showing your legal status in the country, provide a certified passport copy (and bring your original), the original and a certified copy of the Mexican partner’s birth certificate and photo ID, and a letter. The letter must be signed by both applicants, be addressed to the Instituno Nacional de Migracion, and state that neither applicant has any legal impediment to getting married. If you have been married before, you will need a certified copy of the divorce decree or death certificate, and if these were issued in the US, they must be apostilled in the US for use in Mexico. Furthermore, you’ll be asked for an affidavit of single status.

* Some families remain very traditional when it comes to relationships and marriage, while others are more “Americanized” and will more quickly accept you. In any case, make sure your spouse’s family has some input into the marriage process and ceremony if that’s important to both of you.
* Some states require chest x-rays and blood tests before allowing marriage. Check with the office as soon as possible to make sure, as you will have to get these done in Spanish and pay fees, along with submitting them during a particular time frame.
* Religious marriage ceremonies are common, but do not replace civil marriage and have no legal standing. Before or after the religious ceremony, you will need to follow the above process so you are legally married.
